Fireflies Talk Supplemental Terms

These Fireflies Talk Supplemental Terms (the “Talk Terms”) apply to your use of Fireflies Talk (“Talk”), a dictation feature of the Fireflies desktop application. They are Supplemental Terms under Section 1(a) of the Fireflies Terms of Service (the “Terms”), are incorporated into the Terms by Section 11(d), and are part of your agreement with Fireflies. They also describe what Talk collects and how we handle it, and supplement our Privacy Policy. Capitalized terms not defined here have the meanings in the Terms. If the Talk Terms conflict with the Terms, the Talk Terms control for Talk.

1. What Talk does and what it captures

Talk turns your speech into text in the application you are using. You start and stop a dictation with a keyboard shortcut. Talk captures your voice only while a dictation is active, and the application displays an indicator while it is listening.

When you stop a dictation, Talk also captures limited information from the application you are using at that moment (“Screen Context”). Talk uses Screen Context to format your dictation for that application and to improve accuracy. You can turn Screen Context off at any time (see Section 6).

2. Screen Context may include other people’s information

Because Talk reads text from the application you are using, Screen Context may include information about people other than you — for example, a message someone sent you, a name in a customer record, or a document a colleague shared. You are responsible for using Talk only where you have the right to do so, including by providing any notice and obtaining any consent that applicable law or your obligations to others require. Section 5(d) of the Terms (Consents and Third-Party Rights) applies to Screen Context in the same way it applies to meeting content.

3. Talk is not a meeting recorder

Talk is for live dictation of your own words. You will not use Talk to record, capture, transcribe, or summarize any meeting, call, or other conversation involving other people, and you will not submit previously recorded audio, or audio routed from another application or device, to Talk. To record a meeting, use the Fireflies notetaker, which notifies participants. These restrictions are additional restrictions under Section 6(a) of the Terms and may be enforced under Section 6(d).

4. Sensitive information

Do not use Talk while viewing:

(a) protected health information — Talk is not covered by any business associate agreement with Fireflies;
(b) payment card numbers, passwords, authentication codes, or other credentials;
(c) information you are prohibited from disclosing by law, privilege, or confidentiality obligations; or
(d) anything else you do not want sent to Fireflies and our service providers.

You are responsible for the information you choose to capture with Talk.

5. How we process dictations and Screen Context

To transcribe and format your dictation, the application sends your dictation audio, the transcribed text, and the Screen Context for that dictation to Fireflies and to the providers listed at trust.fireflies.ai/subprocessors.

We do not store dictation audio or Screen Context on our servers after your dictation has been processed, and we do not write them to our logs.

If you choose to send us feedback about a dictation, we handle what you send as described in the Privacy Policy.

Your dictations, Screen Context, and the resulting text are your User Content under Section 5 of the Terms and your Inputs and Outputs under Section 10 of the Terms.

6. Your choices

Talk is off until you turn it on in the application under Settings › Dictation, and you can turn it off there at any time.
You can turn Screen Context off in Settings › Dictation. With Screen Context off, Talk transcribes your dictation without reading the application you are using.
The text of your dictations is stored on your device; you can delete any dictation or clear your dictation history in Settings › Dictation.
If you use Fireflies through a workspace, your workspace administrator can turn Talk off for the workspace. If they do, Talk is unavailable to you in that workspace.

7. Changes and contact
